Acceptable Use Policy (AUP)

This Acceptable Use Policy describes acceptable and unacceptable use of the xcPEP and xcPROC services provided by Advanced Structures India Pvt. Ltd. (ASI). This AUP is part of and incorporated into the Terms of Service at tos.xcpep.com. Capitalized terms have the meaning given in the Terms of Service. ASI may suspend or terminate access for violations.
By using the services, you agree to comply with this AUP and to ensure that your Authorized Users also comply.
1. General Rule
Use the services only for lawful, internal business purposes and in a manner that does not harm the services, ASI, or other users.
2. Prohibited Activities
You may not use the services, and you may not allow anyone else to use the services, for any of the following.
2.1 Illegal or Harmful Use
- using the services in violation of applicable laws or regulations
- storing or transmitting content that is fraudulent, defamatory, abusive, harassing, or hateful
- promoting violence, discrimination, or illegal acts
- violating the privacy or rights of others
2.2 Infringement of Rights
- uploading or sharing content without having the rights to do so
- infringing copyrights, trademarks, patents, trade secrets, or rights of publicity or privacy
- distributing unauthorized or unlicensed copies of protected material
2.3 Security Violations
- attempting to gain unauthorized access to any ASI system, account, or data
- probing, scanning, load testing, penetration testing, or otherwise testing the vulnerability of systems without written permission
- bypassing or trying to bypass authentication, access controls, or usage controls
- introducing malware, viruses, worms, or any other harmful code
- attempting or coordinating denial of service attacks
2.4 Service Integrity and Performance
- interfering with or disrupting the availability, integrity, or performance of the services
- using automated tools such as bots, scrapers, or scripts to extract data or make excessive requests, including through an ASI documented API, in a way that exceeds published limits, degrades the service, or attempts bulk extraction
- consuming storage, bandwidth, or other resources in a way that is clearly outside normal xcPEP or xcPROC usage, for example using the service as a general file store for unrelated large media files
- attempting to overload or stress test the service without ASI’s written permission
2.5 Misrepresentation and Unsolicited Messages
- impersonating any person or entity or falsely stating an affiliation
- sending spam, phishing, or other unsolicited bulk communications through the service
- using the service to run fraudulent schemes or misleading promotions
2.6 Use of Outputs for AI or ML
You may not use any part of the services, any data in xcPROC, or any output generated by xcPEP to train, test, or improve any machine learning model or artificial intelligence system, whether commercial or non commercial, unless ASI has given prior written permission. You may not systematically harvest or copy service content with automated agents for the purpose of model building.
2.7 Prohibited or Highly Sensitive Data
Unless ASI has agreed in writing, do not upload or process data that requires special regulatory handling which the services are not certified for, such as protected health information, payment card data, or classified government data. If you are unsure about a data type, contact infosec@xcpep.com.
2.8 Privacy Violations
- collecting personal data about others without consent where consent is required
- publishing or sharing private information about others without permission
- scraping other customers’ data or metadata from the service
2.9 Abusive or Offensive Content
- content involving exploitation or harm to minors
- obscene, pornographic, or inciting content
- content that constitutes harassment or hate speech
2.10 Interference with Other Customers
- attempting to view, modify, or delete another customer’s data
- actions that degrade service for other customers
2.11 Reverse Engineering and Copying
- decompiling, reverse engineering, or attempting to discover source code or underlying ideas, except where such restriction is not allowed by law
- removing or altering ASI’s copyright or proprietary notices
- using the services or outputs, including via APIs or automated tools, to create a competing product or service or to construct a dataset that replicates ASI proprietary data
2.12 API Abuse and Automated Extraction
- using any interface, including ASI documented APIs, to make excessive or automated calls or to bypass published rate limits
- scraping or bulk exporting xcPROC or other ASI proprietary data through APIs or automated tools
- using API responses to train, test, or improve AI or ML models on ASI service data without ASI’s prior written permission
- actions that result in ASI throttling or suspending API access to protect service stability or ASI intellectual property
2.13 Third Party Integrations
- connecting third-party systems or automations that access the services without ensuring they follow this AUP
- allowing an integration to make excessive or abusive API calls on your behalf
3. Data Ownership Alignment
That will read exactly like the rest of your Terms/AUP and keeps enforcement in the AUP while the licence/IP controls stay in the Terms.
- Data created by customers inside xcPEP is owned by the customer and must be handled according to the Terms of Service.
- Data in xcPROC is researched and owned by ASI. Scrape, bulk export, mirror, or create a substitute of xcPROC data is not permitted.
- You may not resell or redistribute xcPROC data or derived datasets unless ASI has provided written consent.
4. Enforcement
ASI may monitor for compliance with this AUP. ASI may investigate suspected violations. If ASI believes a violation has occurred, ASI may take one or more of the following actions:
- ask you to remove or correct the offending content or behavior
- suspend user accounts or API access
- suspend or limit the affected customer environment if the violation threatens security, legality, or service stability
- terminate access in serious or repeated cases
- report unlawful activity to the appropriate authorities
Where it is reasonable and lawful to do so, ASI will attempt to notify the customer and give an opportunity to correct the issue. ASI may act immediately without prior notice if the violation is severe, intentional, or creates a security or legal risk. ASI’s good faith determination that a violation has occurred will be sufficient to take the actions above.
Service credits and refunds are not provided for interruptions or suspensions that result from violations of this AUP.
5. Customer Responsibility
You are responsible for:
- the actions of your Authorized Users and anyone who uses your accounts
- ensuring that data you upload is lawful and that you have the rights to upload it
- promptly addressing any AUP concerns that ASI notifies you about
If ASI incurs loss or damage due to your violation of this AUP, ASI may seek recovery to the extent allowed by the main agreement.
6. Reporting
To report suspected abuse or a violation of this AUP, contact:
- support@xcpep.com for general abuse or misuse
- infosec@xcpep.com for security or data protection concerns
Include dates, times, account identifiers, and a description of the behavior so we can review it quickly.
7. Changes to this AUP
ASI may update this AUP from time to time to reflect changes in the services, in law, or in security requirements. Updated versions will be published at tos.xcpep.com. Continued use of the services after an update means you accept the updated AUP.
